Do North Carolina's Erosion Rules Apply to My Yard? The One-Acre Myth

Here is the thing almost every homeowner gets wrong: under an acre, so the rules do not apply to me.

That is half right, and it is the wrong half.

You are correct that no erosion control plan approval is required below one acre. But two of the four requirements in North Carolina's Sedimentation Pollution Control Act carry no acreage threshold at all. They apply to your back yard exactly as they apply to a subdivision. And your neighbour has a private right of action if your dirt ends up on their property.

What the law actually says

The Act has four operative requirements. Two are keyed to acreage. Two are not, and those two are the ones that reach a residential yard.

  • Buffer zone (G.S. 113A-57(1)) — no acreage threshold. Applies to any land-disturbing activity, whatever the size.

  • Slope angle and 21-day ground cover (G.S. 113A-57(2)) — no acreage threshold. This is the one that catches people.

  • Sediment retention (G.S. 113A-57(3)) — more than one acre. Keep sediment inside your property lines during the work.

  • Plan approval (G.S. 113A-57(4)) — more than one acre. File a plan 30 or more days before starting. Not required for a typical yard.

The 21-day rule

G.S. 113A-57(2) requires that slopes left exposed be planted or otherwise provided with temporary or permanent ground cover, devices or structures sufficient to restrain erosion within 21 calendar days of completion of any phase of grading.

Twenty-one days. Any phase. Any size job. If you strip a bank in March and leave it bare until the weather is nicer, you are outside the statute on day 22.

One piece of statutory precision worth knowing: the acreage tests read more than one acre, not one acre or more. Exactly one acre does not trip the state plan requirement. One acre does trip the separate federal construction stormwater permit, so that distinction matters mainly to builders rather than homeowners.

Local rules are usually stricter, and they are the ones that bite

Cities and counties may adopt their own erosion programs with lower thresholds, and around Charlotte they have. Anything you read about local thresholds is a local ordinance, not a statewide rule. Verify with your own jurisdiction before you start, because that is the office that will knock on your door.

What it costs to get this wrong

G.S. 113A-64 sets a maximum civil penalty of $5,000 per violation, and each day of a continuing violation counts as a separate violation. A knowing or wilful violation is a Class 2 misdemeanour.

Separately from any of that, G.S. 113A-66 gives any person injured by a violation — read: your neighbour downhill — a private right of action, with costs and reasonable attorney's fees awarded where actual damages are $5,000 or less.

That second one is why nobody will notice is not a strategy. The person who notices lives below you.

Slope ratios, and where each one stops working

A ratio like 3:1 means three feet horizontal for every one foot vertical. A bigger first number means a gentler slope.

There is no single NC DEQ maximum slope ratio. What the Design Manual publishes is a set of practical ceilings for specific purposes, and together they form a ladder:

  • 4:1 and flatter (about 14 degrees): routine mowable lawn. Longest stabilization window under the construction permit.

  • 3:1 (about 18 degrees): NC DEQ's ceiling for both mowing and tractor maintenance. Steeper than this, groove or furrow on the contour before seeding.

  • 2:1 (about 27 degrees): NC DEQ's practical ceiling for grass. Finished cut-and-fill slopes to be vegetated with grass and legumes should not be steeper than 2:1. NC State adds that straw mulch is used on slopes flatter than 2:1 to avoid failures — so at 2:1 you are into blankets, not straw.

  • Steeper than 2:1: outside NC DEQ's stated design range for vegetation alone. Regrade, terrace, or build a wall.

  • 1:1 (45 degrees): NC Cooperative Extension puts the limit here — a slope should not be over 45 degrees, because any steeper and plants have difficulty taking root. Their advice at that point is to regrade or build a wall.

Breaking up a long slope

Length matters as much as steepness, because water accelerates as it runs. NC DEQ's Land Grading practice specifies slope breaks — diversions or benches — at these vertical spacings:

  • 2:1 slope: every 20 vertical feet

  • 3:1 slope: every 35 vertical feet

  • 4:1 slope: every 45 vertical feet

Two more figures from the same practice, useful if someone is building a slope for you: individual vertical cuts in stair-step grading should not exceed 2 feet in soft materials or 3 feet in rocky materials, and fill slopes steeper than 3:1 should be placed in lifts not exceeding 9 inches. A contractor dumping and pushing three feet of fill at a time on a 2:1 slope is building something that will move.

Stabilising it: what to plant and when

NC DEQ's temporary seeding specifications for the Piedmont. Temporary seeding is what you use to satisfy the 21-day rule while you decide on the permanent fix.

  • Late winter / early spring, Jan 1 to May 1: rye (grain) 120 lb/acre plus annual lespedeza (Kobe) 50 lb/acre. 2,000 lb/acre lime, 750 lb/acre 10-10-10, 4,000 lb/acre straw anchored.

  • Summer, May 1 to Aug 15: German millet 40 lb/acre. Same lime and fertilizer, same straw.

  • Fall, Aug 15 to Dec 30: rye (grain) 120 lb/acre. 2,000 lb/acre lime, 1,000 lb/acre 10-10-10, same straw.

Converted to a yard-sized number. Acre rates are useless when you are covering a bank behind the garage. This arithmetic is ours rather than NC DEQ's:

  • Straw at 4,000 lb/acre is about 92 lb per 1,000 sq ft — roughly two standard bales per 1,000 square feet

  • Lime at 2,000 lb/acre is about 46 lb per 1,000 sq ft

  • 10-10-10 at 750 lb/acre is about 17 lb per 1,000 sq ft

And anchor the straw. NC DEQ specifies tacking with asphalt, netting, or a mulch anchoring tool. Loose straw on a slope is decoration until the first storm moves it.

A change worth knowing about

NC DEQ's permanent seeding practice was substantially revised in January 2026, moving away from fixed tall-fescue mixture tables toward a staged approach using non-invasive and native species: an immediate nurse crop, a primary cover for six months to three years, and long-term species. If you are working from an older copy of the manual or an older contractor spec sheet, you are working from the previous version.

Piedmont seeding windows under the revised practice include switchgrass at 2.5 to 3.5 lb/acre and indiangrass and big bluestem at 5 to 7 lb/acre, all December 1 to April 1; Indian woodoats at 1.5 to 2.5 lb/acre and Virginia wild rye at 4 to 6 lb/acre, February 15 to April 1.

And one row worth reading twice: NC DEQ flags hard fescue as not recommended for slopes over 5 percent. Five percent is roughly 20:1 — barely a slope at all. That effectively rules hard fescue out of any real slope job, which is worth knowing before you buy a bag of it because the label says erosion control.

Blankets, mats and silt fence

These are different products with different jobs. A blanket is temporary: it holds seed and soil while vegetation establishes, then degrades. A turf reinforcement mat is permanent, stays in the soil, and reinforces the turf against flows grass alone could not survive.

NC DEQ's selection criteria are velocity-based, not slope-based. Design velocities above 2 feet per second require temporary blankets, mats or similar liners. Grass-lined channels with design velocities above 6 feet per second should include turf reinforcement mats.

There is no NC rule saying matting is required at a particular slope ratio. What the sources do support is that at 2:1 or steeper, straw alone fails, so you are into a blanket, a compost blanket, or hydraulic mulch.

Installing a blanket, per NC DEQ

Terminal anchor trenches a minimum of 12 inches deep and 6 inches wide. Intermittent check slots 6 by 6 inches. Minimum 6-inch longitudinal overlap. Staples 11 gauge, at least 6 inch by 1 inch, or 12-inch wooden stakes, on a 3-foot centre-to-centre pattern. On slopes flatter than 3:1 rolls may run in horizontal strips; steeper slopes require different placement.

And the sequencing, which NC DEQ prints in capitals: prepare soil and apply seed before installing blankets or mats. The blanket goes over the seed, not instead of it. Lime, fertilize and seed first, and get the surface smooth so the blanket makes soil contact. A blanket bridging over a rut protects nothing underneath it. Inspect at least weekly and after each rainfall of one inch or greater.

A netting warning worth repeating. NC DEQ advises that netting incorporating plastic mesh or plastic twine should not be used in wetlands, riparian buffers or floodplains, because of potential small animal mortality. That is the snake and lizard entanglement problem. Buy 100 percent biodegradable, loose-weave netting near any water. It costs slightly more and it is the right thing to do.

This is the single most misunderstood item in residential erosion control. People install it on a slope expecting it to hold soil in place. That is not what it is for and not what it does.

NC DEQ's stated purpose is to retain sediment from small disturbed areas by reducing the velocity of sheet flows to allow sediment deposition. It is a filter at the bottom, not a retainer on the face. And it is temporary — NC DEQ requires removal once the drainage area above it is stabilised.

Do not install silt fence across streams, ditches, waterways, or any area of concentrated flow. It is designed for sheet flow, and concentrated water simply blows through or around it. NC DEQ also states directly that sediment fences should not be used alone below graded slopes greater than 5 feet in height.

Maximum slope length above a silt fence:

  • Under 2 percent: 300 feet

  • 2 to 5 percent: 150 feet

  • 5 to 10 percent: 75 feet

  • 10 to 15 percent: 25 feet

  • Over 15 percent: 15 feet

Read that bottom row. Above a 15 percent slope, one run of silt fence is rated for fifteen feet of slope above it. A typical residential bank is far longer than that, which is why a single line of fence at the bottom of a big slope fails in the first real storm and everyone concludes silt fence does not work. It works. It was asked to do something it was never rated for.

Fourteen ways this goes wrong

  1. Treating silt fence as a retaining device.

  2. Running silt fence across a ditch or any concentrated flow.

  3. One line of fence below a bank taller than 5 feet.

  4. Leaving a bank bare over winter. The 21-day rule has no acreage threshold and no seasonal exemption.

  5. Laying blanket over unprepared ground.

  6. Leaving straw unanchored.

  7. Seeding outside the window and hoping.

  8. Buying hard fescue for a slope.

  9. Mowing a slope steeper than 3:1 — that is a safety limit as much as an agronomic one.

  10. Seeding a steep slope without grooving on the contour first.

  11. Placing fill in lifts deeper than 9 inches on slopes steeper than 3:1.

  12. Sending more water onto the slope. Nothing on this list survives a downspout discharging over the crest of a bank. Fix the water first.

  13. Plastic-mesh netting near water.

  14. Assuming a small wall is exempt from engineering. Support a structure or cross a property line and design is required at any height. (There is a separate post on the retaining wall rules, which changed on January 1, 2025.)

What we could not find, and will not invent

Every guide has gaps. Most do not tell you where they are.

  • A maximum permitted slope ratio. NC DEQ does not publish one. What it publishes are practical ceilings for specific purposes, which is why the ladder above is assembled from several statements rather than quoted from one.

  • A rule requiring matting at a given slope ratio. There is not one. The criteria are velocity-based. Any claim that you must use matting above 3:1 is somebody's rule of thumb, not North Carolina's.

  • A formal NC definition separating erosion control blankets from turf reinforcement mats. The fuller product taxonomy — longevity classes, type numbers — comes from industry standards and manufacturers, not from NC DEQ.

  • The silt fence maximum drainage area figure. The slope-length table above was consistent across repeated checks. The companion maximum-area column was not. We have printed only the column we trust.
