Can Your HOA Ban a Rain Barrel in North Carolina?

Two North Carolina statutes stop your city, your county and the state building code from banning a rain barrel. Neither one stops your homeowners association. That gap is the single most consequential thing to know before you buy a tank, and almost nothing written about rainwater harvesting in this state mentions it.

The two statutes that do protect you

Layer one, 2009 — building codes. G.S. 143-138(b12), titled "Cisterns," was enacted by S.L. 2009-243 and ratified on 25 June 2009. The operative sentence: "No State, county, or local building code or regulation shall prohibit the use of cisterns to provide water for flushing toilets and for outdoor irrigation."

Layer two, 2011 — ordinances generally. Two years later the General Assembly went further and reached ordinances, not just building codes. G.S. 160A-202 applies to cities and G.S. 153A-145 applies to counties. Both are titled "Limitations on regulating cisterns and rain barrels" and carry identical language: "No city ordinance may prohibit or have the effect of prohibiting the installation and maintenance of cisterns and rain barrel collection systems used to collect water for irrigation purposes."

Both 2011 statutes were confirmed still in force and were not swept into the Chapter 160D development-regulation recodification. A city or county may still regulate installation and maintenance to protect public health and safety and to prevent a nuisance — mosquitoes, mainly — but it may not prohibit.

The gap nobody writes about

Every one of those laws is directed at government action. A city ordinance. A county ordinance. A building code. None of them reaches a private restrictive covenant, a declaration, or an HOA architectural rule.

And North Carolina has no rain-barrel covenant statute. The chapter where such a protection would live — G.S. Chapter 22B, Article 3, "Deed Restrictions, Covenants" — contains exactly one section: §22B-20, which voids deed restrictions prohibiting solar collectors. Article 3 contains no reference to rain barrels, cisterns, rainwater harvesting, rainwater collection, or water conservation anywhere in it.

The honest caveat, which you will not find on a blog. I could locate no North Carolina appellate decision applying §143-138(b12), §160A-202 or §153A-145 to an HOA covenant. The conclusion above is drawn from the statutory text and from the General Assembly's silence in Chapter 22B. It is an argument from what the law does not say. If a covenant is standing between you and a cistern, that is a question for a North Carolina attorney. I am a licensed contractor, not an attorney, and this is not legal advice.

What the water may be used for

NC sources genuinely conflict here, because the plumbing code changed and NC DEQ's website did not keep up.

The superseded 2009 NC Plumbing Code Appendix C-1 — still linked from DEQ's own rainwater page — limited harvested rainwater to flushing water closets and urinals, and required filtration, disinfection, blue or green dye, non-potable pipe labelling and backflow protection.

The current NC Plumbing Code Chapter 13, "Nonpotable Water Systems," is far more permissive and is organised in two tiers. Appendices C and E are not specifically adopted, so the old Appendix C-1 is not mandatory.

  • §1301.2.3.1 — no treatment required: outdoor irrigation, decorative fountains, yard hydrants, dust control, vehicle washing, and outdoor hose bibs not routed through a building wall.

  • §1301.2.3.2 — disinfection and filtration required: toilet and urinal flushing, cooling-tower make-up, trap primers, fire suppression, clothes washers, outdoor pools and spas, and residential hose bibs.

Standing in your yard, that means watering the garden from a barrel needs no treatment at all under the current code. Piping the same water to a toilet triggers disinfection, filtration, non-potable marking and backflow protection — a permitted plumbing job, not a Saturday afternoon.

§1303.3 also requires downspouts and leaders connected to a roof washer to carry a debris excluder to keep leaves, sticks and pine needles out of the collected water.

Drinking it: North Carolina is uniformly against

15A NCAC 02H .1057(6) requires all harvested rainwater outlets to be labelled "Non-Potable Water." The NCDA&CS Cistern Design Manual describes the water as non-potable only. NC State Extension warns that harvested rainwater may contain pathogens and pollutants at levels posing health concerns if consumed without proper treatment.

Worth knowing: NC State's own water resources page refers readers out of state, to Texas A&M, for making rainwater potable. North Carolina publishes no potable rainwater guidance of its own.

Edible crops: a qualified yes, with a soil warning

NC State Extension AG-588-18W, Water Quality of Rooftop Runoff, is the only North Carolina statement on food crops I could find: "If collected water is used to irrigate edible plants, wash the food thoroughly with treated water before consuming any part of the plant."

The same publication recommends soil testing, because zinc accumulating from roof runoff can cause phytotoxicity — poisoning of the plants themselves. NC State's produce safety programme does not address harvested rainwater as an irrigation source at all, and publishes no E. coli threshold or testing interval for it.

How much water you are actually talking about

NC DEQ publishes 600 gallons per 1,000 square feet of roof per inch of rain. The pure arithmetic gives 623: 1,000 sq ft x (1 in ÷ 12) = 83.33 cubic feet x 7.48 gallons per cubic foot.

The roughly four percent difference is consistent with a collection-efficiency allowance — first flush, the roof wetting before anything runs off, evaporation, water overshooting the gutter. But DEQ nowhere states why it uses 600, and does not label it efficiency-adjusted. Both numbers are printed here rather than reconciled on DEQ's behalf.

Practical rule. Use 600 when sizing a tank, because you will not catch everything. Use 623 when working out how much water is hitting your foundation, because none of those losses help you there.

The sizing rule that does not apply to you

15A NCAC 02H .1057, effective 1 January 2017, is the binding Minimum Design Criteria rule for rainwater harvesting systems. It requires the system to be sized for 85 percent of total annual runoff volume, demonstrated through water balance calculations run in the NCSU Rainwater Harvester model or another continuous-simulation hydrologic model, using at least five representative years of actual rainfall records.

Two NC DEQ documents give two different percentages: BMP Manual C-7, revised 20 November 2020, says 85 percent; BMP Manual Chapter 25, still a final draft, says a minimum of 86 percent. The rule says 85, and a rule outranks a manual — certainly one still labelled draft.

None of that applies to a garden barrel. The rule governs when a rainwater harvesting system is being credited as a primary Stormwater Control Measure to satisfy a state or local stormwater permit on regulated development. A homeowner setting a 55-gallon barrel under a downspout for the tomatoes is not claiming an SCM credit and is not required to run an 85-percent-capture, five-year water balance in the NCSU model. Know that before somebody quotes it at you.

What does still reach you: the plumbing code if the water goes indoors, mosquito and nuisance regulation by your city or county, and your HOA.

For homeowner-scale rules of thumb, NCDA&CS suggests one gallon of storage for every square foot of drainage area, and DEQ's C-7 suggests starting iterative calculations at the same ratio. Those are starting points for a calculation, not a design.

Mosquitoes: two NC State numbers that disagree

NC State Extension AG-588-28, Mosquito Control for Rainwater Harvesting Systems (31 March 2021), says mesh should be finer than 1/16 inch — about 1,587 microns. NC State Extension's Rainwater Harvesting: Guidance for Homeowners says any open pathway should be covered by mesh of 1 millimetre or smaller — 1,000 microns.

Both are NC State. The homeowner publication is roughly 50 percent stricter. Use the 1 millimetre figure — it satisfies both, and the cost difference on a roll of screen is trivial.

On larvicides the two sources also diverge. AG-588-28 names s-methoprene, an insect growth regulator specific to mosquitoes, and says spinosad products are effective but should not be used where the water will be consumed by people or livestock. DEQ's C-7 instead says to check and repair screens and treat with mosquito dunks if necessary — standard dunks are Bti, which NC State's dedicated mosquito publication does not mention at all.

One correction to something you will read elsewhere: NC DEQ does say cistern material should block light, but the stated reason is algae, not mosquitoes.

Installation numbers worth knowing

  • Tanks of 1,500 gallons or less: aggregate or gravel base 6 to 8 inches deep.

  • Over 1,500 gallons: concrete pad 4 to 6 inches thick.

  • Over 3,000 gallons: must be designed by a professional engineer.

  • Base depression at least 12 to 18 inches deep to keep pipes from freezing; exposed piping buried at least a foot or insulated.

  • A cistern should not be buried more than 2 feet deep.

  • Backflow protection is required wherever a potable supply can reach the system.

Chapter 25 Table 25-7 asks for a first flush that holds and slowly discharges the first 0.04 inches of rainfall — but Chapter 25 is a final draft, and the adopted C-7 manual contains no first-flush volume at all. DEQ notes elsewhere that pollen, not roof grit, is the main reason to have a diverter in this region, because a typical debris filter will not remove it.

The overflow requirement reads as three different rules across three documents. They are reconcilable in practice, and the practical version is short: the overflow has to go somewhere deliberate, and not against the house.

And a real gap: North Carolina publishes no winterising procedure. The 12-to-18-inch depression and the bury-a-foot-or-insulate rule are the only cold-weather specifications the state puts in writing. No NC source tells a homeowner how to drain down a barrel for winter.

When the barrel is not the answer

A rain barrel is a watering can. If the reason you are looking at one is that water is arriving somewhere it should not — against a foundation, across a driveway, in the same low spot after every storm — that is a grading and drainage question, and a barrel will not move the needle on it.
